High Court Dismisses Petition Against Wave City, Farmers’ Union Faces Setback

Ghaziabad (UP): The High Court has dismissed the petition filed against the police action of removing farmers’ protest demonstrations held illegally against Wave City. The court stated that the allegations made by the petitioner were baseless and that the protest itself appeared unlawful.

The petition had been filed by local resident Pramod Dawas, challenging the police action of dispersing the farmers’ sit-in protest. During the hearing, the High Court ruled that the petitioner’s claims had no legal standing.

It is noteworthy that local farmers had been protesting against Wave City since March 15, 2025, demanding implementation of the agreement dated May 20, 2014. Farmers had occupied the road in protest. Wave City lodged a complaint under Section 252 of the BNS with the Assistant Commissioner of Police (ACP) Wave City.

After hearing both sides, ACP Modinagar Gyan Prakash Rai issued an order on June 25, 2025, observing that the farmers had illegally encroached on the 57-meter road of Wave City, causing inconvenience to the public, school children, and ambulances. He gave the farmers three days to vacate the site. However, when the order was ignored, police removed the protestors on August 3, 2025. Some arrested farmers were later released on bail on August 6, 2025.

Against this police action, resident Pramod Dawas filed Writ Petition No. 696/2025 in the High Court. On August 25, 2025, the High Court dismissed the plea, declaring it non-maintainable.

With this dismissal, the farmers have lost their demand for 8% of land parcels, as the time limit set under Clause 6 of the May 20, 2014 agreement has already expired. The farmers had also sought enforcement of the same agreement under Clause 7, but the court rejected this argument as well.

Meanwhile, a heavy police presence remains at the protest site. Authorities have stated that they are fully prepared to handle any disturbance if farmers attempt to create unrest again.
