Delhi High Court Transfers Naresh Balyan’s MCOCA Case to MP-MLA Court
New Delhi : The Delhi High Court has ordered the transfer of the MCOCA (Maharashtra Control of Organized Crime Act) case against Aam Aadmi Party (AAP) legislator Naresh Balyan from Dwarka Court to the MP-MLA Court located at Rouse Avenue. This order was passed by a bench of Justice Manoj Kumar Ohri.
On Thursday, the lawyers representing two accused, Rohit alias Anna and Sachin Chikara, stated that they had no objection if the case were transferred to the MP-MLA Court at Rouse Avenue. Earlier, on December 18, another accused, Ritik alias Peter, had also expressed no objection to the transfer of the case.
Earlier, on December 16, the High Court had issued a notice to the three accused in the case. Delhi Police’s lawyer, Lakshya Khanna, had stated that the case against the three arrested accused was ongoing in Dwarka Court. AAP legislator Naresh Balyan, who represents Uttam Nagar, is also an accused in the case. While Balyan’s case was being heard in the MP-MLA Court at Rouse Avenue, the other three accused’s cases were being heard in Dwarka’s MCOCA Court. Since it is not possible to conduct proceedings in two different courts for the same FIR, the High Court ordered the transfer of all the cases to the MP-MLA Court at Rouse Avenue.
In addition to Naresh Balyan, Ritik alias Peter, Rohit alias Anna, and Sachin Chikara are also accused in the MCOCA case. On December 13, Rouse Avenue Court had sent Naresh Balyan, who was arrested in the MCOCA case, to judicial custody until January 9, 2025. Delhi Police had arrested Balyan on the night of November 30 in connection with a recovery case. On December 4, the court granted Balyan bail, but he was re-arrested in the MCOCA case shortly after.
The BJP had released an audio clip of a conversation between gangster Kapil Sangwan alias Nandu and Balyan, alleging Balyan’s involvement in extortion. Following the release of this clip, Naresh Balyan was summoned by Delhi Police’s Crime Branch for questioning, after which he was arrested.
